The Two Days Certified Training Program on Mediation, organized by the School of Law, Galgotias University, in collaboration with AIIMAS, commenced with an inspiring address by the Dean, School of Law, who emphasized the growing importance of mediation in the Indian legal system as a tool for promoting harmony and justice. The Hon’ble Vice-Chancellor of Galgotias University highlighted the essential skills required for effective mediation and how they contribute to the development of empathetic and solution-oriented legal professionals.
During the one-day session, Adv. Jaya Goyal and Adv. Nagina Jain introduced us to AIIMAAS and gave an overview of Lok Adalat, arbitration, conciliation, and mediation. They explained the key advantages of Alternative Dispute Resolution, especially how it ensures quicker resolution, maintains confidentiality, reduces the burden on courts, and is far more economical. They highlighted that nearly 95 percent of disputes settle through mediation, with the remaining matters proceeding to court. The speakers described mediation as a structured, neutral, flexible, creative, economical, and confidential process. They also walked us through the stages of mediation, including the introduction, joint session, single session, and the final agreement or closing, explaining each stage briefly but clearly. Later, they discussed the practical benefits of mediation and its working process. The session also helped us understand communication skills, both verbal and non-verbal, along with different types of questioning techniques.

The session commenced with an address by the Dean of the School of Law, followed by the faculty coordinator, who introduced the objectives of the program and emphasized the growing importance of Alternative Dispute Resolution in the contemporary legal framework. They explained the expanding scope of ADR and its relevance in addressing the increasing complexity of modern disputes. The first day of the program was conducted by Adv. Jaya Goyal and Adv. Nagina Jain, who provided an overview of their organization, AIIMAAS, and introduced the participants to various mechanisms of ADR, including Lok Adalat, arbitration, conciliation and mediation. They highlighted the crucial role of ADR in supplementing the traditional judicial system and outlined its primary advantages. These included the efficient resolution of disputes, the assurance of confidentiality, cost effectiveness and the reduction of the burden on the courts. One of the most significant points shared during the session was that a large proportion of disputes are resolved through mediation, while only a small number ultimately proceed to litigation.
The speakers went on to explain the essential characteristics that make mediation an effective method of dispute resolution. They described it as a structured, neutral, flexible, creative, economical and confidential process. They then presented the stages of mediation in a clear and sequential manner, beginning with the introduction, proceeding to the joint session, followed by individual sessions, and concluding with either an agreement or a formal closing discussion. Each stage was supported with practical examples and references to relevant case law to assist the participants in understanding how mediation operates in practice. The fundamental principles that guide the mediation process, including neutrality, voluntariness and confidentiality, were also discussed in detail to provide a stronger conceptual base.
After covering the procedural aspects, the session focused on the communication skills required for effective mediation. The participants were introduced to both verbal and non-verbal communication techniques. Particular attention was given to the significance of body language, tone, eye contact and active listening in influencing the course of a mediation session. The speakers also explained the various types of questions that mediator’s use, such as open ended, probing and clarifying questions, to guide discussions and foster a cooperative atmosphere between the parties.
The program concluded with a role play exercise in which participants assumed the roles of the mediator, the disputing parties and counsel. This practical activity allowed the students to apply the theoretical knowledge they had gained and offered valuable insight into the real life functioning of mediation. Through this experiential learning exercise, the participants were able to appreciate not only the procedural framework of mediation but also the interpersonal skills necessary for effective dispute resolution. Overall, the session provided a comprehensive and well-structured introduction to the principles and practice of ADR and significantly strengthened the participants’ understanding of mediation as an important contemporary method of conflict resolution
