About the Course



School of Law, Galgotias University in collaboration with Universal Institute of Legal Studies & Law Curators inaugurated the prestigious Value added course "Advanced Course on Judicial Service & Professional Advocacy" on 10th January 2022. This Course is mentored by Justice J.R. Midha (Retd.) who has joined the University as Advisor and Professor Emeritus. Justice Midha’s has a vision to reform legal education and this is a step towards that initiative.

Fundamental of law, communication skills and rational thinking, this course has been designed for the law students/law graduates who want to practice in Courts as well as for those who want to appear in Judicial Service Examination

Galgotias University has launched this Advance Course in collaboration with Universal Institute of Legal Studies (UILS) of the Universal Law Group, headed by Dr. Manish Arora and Law Curators (Institute) under the guidance of Mr. S.P. Jain, noted and experienced legal practioner. Besides, eminent judicial experts in the relevant fields will take the classes in their domain to provide better clarity and practical understanding

The advanced course on Judicial Services Examination & Professional Advocacy Skills is classified into three sections beginning with Introductory and Basic Understanding of the subject to be undertaken by Justice Midha himself and followed by comprehensive preparation of all subjects of Judiciary Examination anchored by Mr. S.P Jain of Law Curators and Dr. Manish Arora of UILS will be involved with evaluation of students to bring finesse to their answer writing skills. Dr. Manish Arora and his associates shall also be involved with the training for General Studies and Local Laws. As an overall assessment and final preparation exercise, Justice Midha will also undertake training of students for the interviews in their final selection round.

Why Judicial Service?

A career in judicial services not only gives one an opportunity to serve one’s fellowmen and see justice being delivered, it also has good financial incentives such as handsome pay alongside perks and privileges like rent-free accommodation, free water and electricity, chauffeur-driven court vehicle and bursaries for one’s kids’ education, and still many more. Ideally, the quality and quantity of these perks are comparable to or better than those of civil service officers.

Unlike administrative and police officers, judicial officers and posted in district headquarters, so they never have to serve in remote areas. This gives rest to the concern regarding the quality of their kids’ education as also the availability of basic amenities.

Keeping in mind the best interests of our students, we have decided to provide specialized training for Judicial Service Examination at the campus itself, so that our students have an extra edge in this highly competitive exam.


Specifications of the course

The Advanced Course shall be conducted in collaboration with Universal Institute of Legal Studies and Law Curators who are known in the field of training for Judicial Service Examinations for more than a decade.

The Advanced Course shall be conducted four days a week i.e. Tuesday, Thursday, Saturday and Sunday every week. The detailed time table shall be circulated to the students by 3rd January, 2022.

The University has decided to bear the entire cost of this course and no Fees shall be charged from the students, but the students have to bear the cost of Course materials on the relevant subjects. The study material cost of Rs.11,500/- be deposited by the students.

The students who have opted for this Course shall note that the attendance to this course shall be mandatory and shall be counted for main degree/ course undertaken by the students.

Justice J.R Midha's vision is to reform legal education. He encouraged students to develop advocacy skills by developing the communication skills and logical/legal reasoning and rational thinking in developing professional advocacy

Teaching Law at Galgotias University. Reforming the legal education with stress on Fundamentals of Law, Communication Skills, and Rational Thinking. Imparting value-based education to law students.

Arbitrator and Legal Consultant. Appointed as an Arbitrator by the Delhi High Court in several cases.

On the panel of arbitrators of Delhi International Arbitration Centre (DIAC), Indian Council of Arbitration (ICA), and Indian Dispute Resolution Centre (IDRC).

Appointed as an Administrator of Shri Kalkaji Mandir, New Delhi by the Delhi High Court.

11th April, 2008 to 07th July, 2021

Served as a Judge of Delhi High Court for more than 13 years. As a Judge, dealt with cases of various jurisdictions and rendered several landmark judgments.

Lived by and worked on the principle that Justice is Truth in Action; truth is the foundation of justice; and dispensation of justice, based on truth, is an essential feature in the justice delivery system. Laid down the principles relating to search for Truth in Ved Prakash Kharbanda v. Vimal Bindal, (2013) 198 DLT 555. His quotation "In the Court of Justice, both the parties know the truth, it's the judge who's on trial" in his retirement speech became viral on social media.

Actively initiated judicial reforms in various jurisdictions namely, Arbitration, Motor Accident Claims, Execution Cases, Maintenance in

Matrimonial Cases, Compensation to Victims of Crime, Prosecution for False Claims, Proclaimed Offenders, etc.

Contributed majorly to the cause of 'Victims of Road Accident' by framing Special Scheme on 21st December 2009 in Rajesh Tyagi's case for expeditious payment of compensation to victims of road accident within 90 to 120 days of the accident. From April, 2010 to July 2012, a total number of 21,830 claims were filed before Motor Accident Claim Tribunals in Delhi out of which compensation was awarded to the claimants within 120 days in 10,762 cases. The Supreme Court upheld this Scheme and directed all the States to implement the same. Gradually improved and modified the aforesaid Scheme in 2014, 2018 and lastly on 8th January, 2021. The latest Scheme of 8th January, 2021 is very comprehensive and contains a time bound method for payment of compensation to the victims of road accident.

Framed FASTDAR Scheme for payment of compensation within ten days of the accident in road accident death cases. The FASTDAR Scheme was launched on 1st May, 2021 and the first case of road accident on 1st May, 2021 was resolved within ten days and the compensation of Rs.32 lakhs was deposited by the Insurance Company on 12th May, 2021.

In Karan v. State NCT of Delhi, 277 (2021) DLT 195 (FB), authored the Judgment of the Full Bench for grant of compensation to the victims of crime under Section 357 CrPC. Framed the guidelines for payment of compensation to the victims of crime. As per the procedure laid down, the accused has to file the affidavit of assets and income within ten days of his conviction whereupon Delhi State Legal Service Authority (DSLSA) shall conduct a Summary Inquiry to compute the loss suffered by the victims and the paying capacity of the accused and submit a Victim Impact Report (VIR) to the Court whereupon the Court shall consider the Report and award appropriate compensation to the victims of crime. This is one of the land mark judgments on the aspect of compensation to the victims of crime.

In H.S. Bedi v. NHAI, 220 (2015) DLT 179, laid down the guidelines for prosecution of litigants who raise false claims. The greatest challenge before the judiciary is frivolous litigation. The judicial system in the country is choked with false claims and such litigants are consuming Courts' time for a wrong cause. False claims are a huge strain on the judicial system. The Court laid down the guidelines for prosecution of the litigants raising false claims.

In Dr. Maya D. Chablani v. Radha Mittal, 2021 SCC Online Del 3599, laid down the guidelines for feeding of stray dogs. While recognising the rights of the animals under Article 21 of the Constitution and other

Statutes and considering that the animals have to be treated with compassion, respect and dignity, the Court directed the enforcement authorities to ensure that no harassment and hindrance is caused to the feeders of stray dogs. The Court further held that if any Government servant indulges in cruelty to animals, action be taken under CCS Rules.

In the recent case of Amazon. v. Future Group, 2021 SCC Online Del 1279, held that the award of an Emergency Arbitrator is enforceable under the Arbitration and Conciliation Act, 1996. This view has been affirmed by the Supreme Court.

In Juhi Chawla v. Science & Engineering Research Board, (2021)280 DLT 1, declined to grant of leave to institute the suit against 5G Technology under Section 91(1)(b) of the Code of Civil Procedure or to sue in representative interest under Order I Rule 8 of the Code of Civil Procedure and dismissed the defective suit with cost of Rs.20 Lakhs.

11thMarch, 2020 to 07th July, 2021

Served as the Chairperson of Delhi International Arbitration Centre (DIAC).During this period, various new initiatives were successfully undertaken, namely: framing of Rules for Empanelment of Arbitrators; Empanelment of Arbitrators under the new Rules; stage wise disbursal of fees to the Arbitrators; improved website with added features; audio - visual tour of DIAC on the website; release of first issue of DIAC Journal of Arbitration; and Guidelines for arbitration proceedings by video conference during pandemic.

11th March, 2020 to 7th July, 2021

Served as the Chairperson of Judicial Education and Training Programme Committee of High Court of Delhi and undertook innovative steps for imparting education and training of Judges and other stakeholders of justice delivery system at Delhi Judicial Academy. The Delhi Judicial Academy successfully conducted numerous online training programmes during the pandemic.

Served as a Member of the Sub-Committee of Supreme Court on use of Artificial Intelligence in MACT cases.

Practiced Law before the Supreme Court, Delhi High Court and other High Courts, including Bombay High Court, Punjab & Haryana High

Court, Allahabad High Court, and Rajasthan High Court. Also appeared as a counsel before the Arbitrators/Arbitral Tribunals.

Represented Govt. of NCT of Delhi as Standing Counsel (Civil) before the High Court of Delhi from May, 2006 until elevation as a Judge in April, 2008.


Teaching Experience

1989 to 1992

Lecturer at Campus Law Centre, Faculty of Law, Delhi University and taught various subjects including Code of Civil Procedure, Indian Evidence Act, Transfer of Property Act, Delhi Rent Control Act Limitation Act, Arbitration Act, Motor Vehicles Act, Court Fees Act, Suit Valuation Act, Indian Registration Act, and Indian Stamp Act. Compiled the synopsis and case material on the subjects of "Pleading and Conveyancing" and "Motor Accident Compensation" for Campus Law Centre.

While teaching, organized a Lok Adalat on Motor Accident Compensation in Campus Law Centre in 1991 in which the compensation was computed by Law students and the computation was given to Lok Adalat Judges in advance to ensure that the claimants get fair compensation.

2008-2021

Even after elevation to the Bench, continued to visit various law schools to deliver guest lectures. Had been a resource person for training of Judges in National Judicial Academy as well as State Judicial Academies.

Dr. Manish continues to preserve his link and stay abreast with the academia by being on the Board of Legal Studies of several Institutes and as Visiting Faculty at National Judicial Academy, Bhopal, Indian Institute of Law, Delhi, University of Queensland, Brisbane, Australia and at Harvard Law School. On the judicial side, he is an Arbitrator appointed by the Ministry of Information Technology, Government of India for Settlement of International Domain Name Disputes and has also participated in Matrimonial matters in the XVIIth Lok Adalat in Delhi. He is Patent Agent, Government of India and Director, India Centre for Fast Arbitration (ICFA), Supreme Court of India. He dons all these hats in different fields with equal elan.
